AOL versus Cyberpromo

A federal judge delivered a blow to marketers flooding the Internet with junk electronic mail, telling a Philadelphia company that it has no First Amendment right to ply America Online Inc. subscribers with unsolicited messages. The opinion by Judge Charles R. Weiner represents a setback for Cyber Promotions Inc., which sends messages to massive mailing lists of on-line subscribers on behalf of advertisers. In September, AOL began blocking Cyber Promotions' mailings, saying junk e-mail was a top complaint among members of the on-line service.
